New EU regulation on the sale of acid for batteries

As of February 1st, 2021, Regulation (EU) 2019/1148 related to the use and the sale of explosives precursors, has entered into force and is applied throughout the European territory.

Sulfuric acid, used as an electrolyte for starting batteries, has been categorized as a precursor of explosives, and thus, falls within the scope of this new regulation which aims to limit the sale and circulation of explosives precursors, that could be used for criminal and/or terrorist actions. The principle is to prevent the use of sulfuric acid (which usually comes in the form of a pack with the unactivated battery), for purposes other than charging and activating a battery. From now on, the sale of batteries with acid pack is now prohibited to end-users. Before selling conventional batteries, professionals have to charge and activate them and will ensure that batteries are delivered to end-users in excellent condition. In this context, SLA batteries, sealed and factory activated, seem to be the appropriate solution. Indeed, these batteries are delivered already charged and ready to use, without any intervention or manipulation of acid. These batteries are considered as non-hazardous products, and fall outside the scope of the new regultation, and can therefore easily be made available to the public.
